Advertisement Terms & Conditions
Booking, approval, delivery and cancellation of advertising.
1. Scope and acceptance
These terms apply to advertisements and sponsored placements purchased from Magpies News for https://magpies.in or any official app or channel expressly included in a booking. The legal operator is identified in the address section. "Advertiser" includes the brand or business buying a campaign; an agency must have authority to act for its disclosed client.
A campaign is accepted only when Magpies News confirms the order in writing. A quotation, uploaded creative or payment alone does not guarantee approval or inventory. A confirmed order records the campaign's commercial terms. These terms, the order and the Payment Policy must be read together; mandatory law takes priority.
2. What the booking must specify
The accepted order should identify:
- Advertiser and agency, authorised contacts, invoice recipient and campaign reference.
- Approved format, such as an image, video, banner, sponsored story, in-story placement or full-screen placement between news cards.
- Destination URL or landing page; approved language, region and other available targeting settings.
- Start and end dates, inventory or delivery basis, spending limit, fees, taxes, payment due date and any production charge.
- Creative dimensions, technical limits, submission and approval deadlines, revision allowance, cancellation costs and the agreed reporting method.
Only formats and controls actually available at booking are included. A quotation is not a guarantee of a particular screen position, audience size or outcome unless the accepted order expressly provides it.
3. Advertiser information and authority
Provide your legal name, business address, reliable contact details, and PAN, GST or other registration information where relevant to billing or required by law. We may request evidence of business identity, agency authority, product approvals or substantiation for claims. An agency's payment responsibility must be stated in the order; undisclosed responsibility is not assumed.
Notify us promptly of a material change to the advertiser, offer or destination page. You must be entitled to advertise in every geography covered by the order.
4. Rights in advertising material
You warrant that you have the rights and permissions needed for the submitted copy, brands, music, images, videos, testimonials and personal likenesses. You grant us a limited right to reproduce, resize, encode and display approved material to fulfil the campaign and maintain necessary compliance records. We will not make a material change to the offer or meaning without approval, except to stop unlawful or harmful publication.
Content approval and editorial separation
5. Advertising standards
Claims must be accurate, supportable and understandable to the intended audience. Prices, eligibility, exclusions, expiry dates and material conditions must be prominent. A disclaimer must not conceal a misleading headline, hidden fee or false promise. Testimonials, endorsements and comparative claims require appropriate evidence and disclosures.
Magpies News will not accept deceptive or unlawful advertising. This includes scams, impersonation, prohibited or surrogate promotions, unlawful betting or gambling, child exploitation, unlawful sexual material, hateful incitement, malware, and claims that falsely promise guaranteed cures, returns or government approval.
Regulated categories, including health, financial services, alcohol, tobacco, gaming and political advertising, are subject to applicable restrictions and prior written clearance where a lawful campaign is possible. Supply licences, certification, election-related approvals and advertising declarations where required. Acceptance of one creative does not approve later changes or every campaign in the same category.
6. Review, corrections and translations
We may ask for supporting material, require changes, reject an advertisement or pause it where there is a reasonable policy, legal, security or reputational concern. Where appropriate, we will explain the issue and allow a corrected version. Review is not a certification of the product and does not transfer the advertiser's duties to us or remove our own responsibilities.
You must review final proofs, including translations, prices, names and contact details, within the agreed schedule. Material translation or meaning changes require approval before publication. Technical adjustments must preserve the substance of the approved message. Delay in supplying or approving creative may affect delivery; any revised dates or costs require confirmation.
7. Paid labels and editorial independence
Paid content must carry a clear label, such as "Advertisement" or "Sponsored", appropriate to its format. Do not request removal of that label or presentation as independent editorial reporting. A media purchase does not secure positive coverage, suppress legitimate reporting or influence a corrections decision.
You may not claim that Magpies News endorses your product or use our brand in external marketing without separate written permission. Ordinary campaign reporting does not create that permission.
8. AI assets and landing pages
Tell us when a creative contains realistic AI-generated or materially altered people, voices or events. Obtain relevant rights, preserve required labels and provenance, and do not use a synthetic testimonial as if it came from a real customer. We may refuse material that would mislead even if it carries a label.
Landing pages must match the approved offer, work properly and provide clear business, payment, refund and privacy information where relevant. They must not install unwanted software, use deceptive redirects or collect personal data without a lawful and clearly explained purpose. You remain responsible for fulfilment of the advertised offer.
Delivery, fees and cancellation
9. Targeting, measurement and outcomes
Audience estimates, forecasts and targeting signals are approximate. We do not guarantee sales, leads, downloads, engagement, rankings or an exact audience profile unless a specific measurable commitment is expressly accepted in writing. Regional delivery may be affected by device settings, connectivity and the accuracy of location signals.
The order must define the billable unit and measurement source, including how invalid activity and reporting discrepancies will be handled. We will reasonably investigate a supported delivery discrepancy. No undisclosed measurement rule or traffic adjustment may be used to increase an agreed spending cap.
10. Schedule changes and underdelivery
We will use reasonable efforts to deliver the accepted campaign. Inventory disruption, technical faults or legal restrictions may require a pause or revised schedule. We will notify you promptly where a material change is known and discuss mitigation.
For paid inventory not delivered because of our inability to fulfil the order, you may choose an agreed replacement placement or a proportionate refund for the undelivered portion. A credit must not be imposed instead of a refund where you are entitled to one. A time-sensitive campaign will not be extended without agreement.
11. Cancellation and rejected material
Request cancellation or changes in writing with the campaign reference. Until accepted, a change request does not alter the booked scope. Where cancellation is possible, you pay for delivery already made and separately disclosed, reasonably incurred and non-recoverable commitments approved in the order. There is no automatic forfeiture of the entire advance.
Any notice period, cancellation fee or non-refundable production component must be disclosed before booking. If none was agreed, we will not introduce it later. If a creative is rejected or a campaign is stopped for an advertiser breach, unused media funds remain subject to an itemised settlement; only valid agreed charges and losses lawfully recoverable may be deducted. The Payment Policy explains refund processing.
12. Invoices and payment
Unless the order states another currency, charges are in Indian rupees. Applicable taxes and any lawful withholding requirements must be handled on the invoice and supported by appropriate records. Pay only through the authorised payment channel or verified bank details on an official invoice. Do not pay a staff member's personal account.
An advance or credit arrangement applies only as agreed. Late payment may lead to a proportionate pause after notice, where practical. Notify us of a disputed charge promptly; we will review it and identify any undisputed balance. Interest, collection charges or penalties apply only if lawfully agreed in advance.
13. Commissioned creative work
Ownership, source-file delivery and reuse rights for separately commissioned creative work must be stated in the production agreement. Your pre-existing assets remain yours. Paying for media space alone does not buy source files, underlying third-party licences or unlimited reuse rights.
Reporting, responsibility and contact
14. Campaign concerns and data
Report a delivery, billing or creative error as soon as practical, preferably within 30 days after the campaign ends, with the order reference and evidence. This recommended reporting period does not extinguish a statutory claim or prevent a justified later complaint. We will investigate and communicate the outcome or next steps.
Campaign reports should use aggregated information where possible. You do not receive identifiable reader data merely by buying advertising. A lead-generation arrangement requires a separate approved data collection notice, lawful permissions, security requirements and agreement defining each party's role. Do not attempt to re-identify readers from reports or use supplied data for an undisclosed purpose.
15. Claims and responsibility
The advertiser is responsible for the claims and rights in material it supplies and for the goods or services it sells. It will reimburse reasonable third-party claim costs caused by its proven unlawful content, lack of rights or material breach, to the extent permitted by law. That obligation excludes loss caused by our own wrongful conduct. We will give reasonable notice and cooperation; no settlement may impose an admission or payment on another party without proper authority.
Neither party guarantees a commercial return. To the extent lawful, liability for remote or unforeseeable loss and indirect business loss is excluded. Nothing limits responsibility for fraud, wilful misconduct, gross negligence, an agreed refund, or any liability that cannot legally be excluded.
16. Events beyond reasonable control
An affected party should promptly explain a disruption, take reasonable steps to limit its impact and propose a revised delivery plan. If a campaign cannot be delivered within a reasonable period or its purpose is defeated by delay, the parties will settle completed work and refund the balance attributable to undelivered services, subject to law and valid agreed commitments.
17. Governing terms and complaints
Indian law applies. The governing-law and competent-forum provisions in the Magpies News Terms & Conditions apply, without removing mandatory consumer or regulatory remedies. Advertising complaints can also be raised under the Grievance Redressal Policy. The order must identify any special terms before acceptance; no later policy change retrospectively alters an accepted campaign.
